Help me understand US Customs...... I have a ring from india that has been inbound at NYC Customs since 2/14?

The ring is only worth $400 but I ordered it with only a 14 day return policy. I have called my shipper and all they say is "nothing we can do". How long is the normal wait for these things? I was told when i ordered it that most likely there would be no duty on it.. but now I am concerned.. could that be the hold up? If so how much would or could duty be on a ring? and How does one pay the duty? Do they hold the package till it is paid? Any advice/direction would be so great!
